Please take the time to read these details in full before signing up. The use of services from Web Kinect, constitutes agreement to these terms.

This page contains important information regarding our terms of service.
When signing up to any of our services, you must agree to comply with the terms of use as described on this page. By paying for a service you are agreeing to abide by these terms of use.

We hope our legal terms are clear and jargon-free but if you have any questions, please don't hesitate to contact us.

Privacy
We take your privacy and security very seriously. We will never pass any of your details on to third parties for any purpose, except when we are required to by law enforcement agencies.
Online transactions are handled through SSL-secured servers and sensitive details such as passwords and credit card details are encrypted to reduce the risk of fraud. We strongly advise that you use hard-to-guess, unique passwords for your accounts with us to reduce the risk of fraud. On rare occasions it is necessary to send out strictly service related announcements. We may also notify you of special offers and updates to our services in our newsletter, and send greetings on special occasions. This website contains links to external sites. Please be aware that we are not responsible for the content of external sites.

Information and data may be automatically collected through the use of Cookies. "Cookies" are small text files that store basic information that a web site can use to recognise repeat site visits and as an example, recall your name if this has been previously supplied. We may use this to observe behaviour and compile aggregate data in order to improve the Site, target the advertising and assess general effectiveness of such advertising.
Cookies do not attach to your system and/or damage your files. If You do not want information collected through the use of Cookies, there is a simple procedure in most browsers that allows you to deny or accept the Cookie feature. Note, however, that "personalised" services may be affected if the cookie option is disabled.

T & C's

The following terms must be agreed to in order to use any of our services. If you do not agree to any of the below, you must not proceed with your order and must inform us immediately. We will be happy to explain any points if you are unsure of their meaning.

Abuse
Customers are responsible for all scripts, data and other objects on their accounts. Abusive scripts are scripts which interfere with our systems and/or the accounts of other customers, cause harm to any other computer system or user, or engage in any type of fraudulent activity. Any account found to be the source of abusive scripts will be immediately suspended and investigated, and subject to action as detailed under Illegal Content. We will always notify customers and, where necessary, fully co-operate with the authorities. We have a zero-tolerance policy against spam and the sending of bulk, unsolicited e-mail is prohibited at all times. Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work.

The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as usernames and passwords.

In the event that an abuse issue arrise our Abuse Department will contact you through our helpdesk ticket system and expect a reply within 48 hours. If we have not heard from you after 48 hours your account will be terminated without refund. We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice. If in doubt regarding the acceptability of your site or service please contact us and we will be happy to assist you.

Anti Spam
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double opt-in" will be treated as spam. Any user who sends out spam will have their account terminated with or without notice and all data in their account will be lost.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or Usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP racks being blacklisted will be immediately suspended and/or terminated.

We reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.

Adult Content
Legal adult content as defined by UK law is allowed on our servers however you must inform us as we will host your site on a separate IP to prevent any SEO implications for other clients.

Illegal Content
Any content deemed illegal by UK law or the law of your country of residence is strictly forbidden and offending accounts will be immediately suspended or terminated at our discretion. We will fully co-operate with the authorities regarding any breach of the law.

Any accounts found to be abusive, contain illegal content or otherwise break our terms of service will be liable for immediate termination with no refund.

Service Level Agreement
We endeavour to provide a 99.9% service uptime, excluding planned or emergency server maintenance or conditions beyond our reasonable control. All customers will be notified of planned maintenance as far as possible in advance through our announcements page in our client area and our Facebook page, should the maintenance last for longer than 30 minutes, via e-mail.

Should we break this SLA in any calendar month with unscheduled service unavailability (as verified by our network monitoring) we will upon request credit a full week's cost to your My.WebKinect account. No hidden catches - we value our service and clients extremely highly.

Payment
Renewal invoices are generated 10 days in advance and sent to your registered e-mail address. It is your responsibility to ensure this e-mail address is kept up to date and can receive e-mails from any '@webkinect.co.uk' address.

All services must be paid for by the due date shown on the invoice unless a written adjustment has been agreed. Failure to complete payment after this time will result in an automatic reminder when the invoice is overdue, and automatic account suspension should the invoice remain unpaid for more than 3 days. If the account remains unpaid for more than 7 days then it will be terminated and all data deleted from our servers. This applies to all hosting accounts, VDS and Dedicated servers. Domain names expire on the day immediately after their renewal date. As such we strongly recommend renewing a minimum of 48 hours before the expiration date. There is a £1 late fee charged every day your account is overdue until day 7 when your account is terminated.

When you first set up your account with us you will be given the option to pay manually or by subscription. If you choose to pay us each month manually you are expected to pay us on or before your invoice due date. If payment is not received by your invoice due date you will be charged £1.00 per day your account is over due and your website suspended until the outstanding invoice is paid or terminated, whichever comes sooner..

Cancellations, Refunds, Terminations & Disputes
Cancellation notices for all services must be given at a minimum of 48 hours in advance of the next billing date, with the exception of yearly paid Web Design packages, Ecommerce packages, VDS and Dedicated servers for which we require a cancellation notice a minimum 30 days before the next billing date. Refunds will be given for every whole unused prepaid month. Refunds will be paid in the form of a credit to your billing account. No cash refunds will be granted unless a payment has been taken in error.

A breach of any of the terms and conditions as described on this page will result in immediate termination with no refund.

Setup fees and Domain Registration or Transfer are non-refundable. Any disputes should be expressed in writing via a valid written contact method as listed on our contact page.

Domain registration, renewal, transfer and restoration
All packages include the option to purchase registration or transfer for a .uk/com/net/org/biz/info/name domain name. All other extensions are excluded from this offer due to their additional cost.. The registration period is one year for all domain extensions except .uk extensions which are registered for two years. All domain transfers include a 12-month registration extension with the exception of all .uk domain types which do not include any form of registration extension, unless they are due for renewal within 6 months. The cost of renewals and additional domain registrations or transfers is £9.99 for all .uk extensions for a 24-month period and £9.99 per year for all other extensions except where otherwise stated at. Certain Hosting packages, Web Design packages and Ecommerce pages include a FREE domain of your choice (subject to availability), from the extensions available. Hosting package renewals do not include a further free domain renewal, transfer or registration.

Web Kinect will always register, transfer and renew domain names in our client's name - never in our own, using the information provided during registration. In the event that you wish to transfer your domain to another provider we will provide you with login information to manage your domain. It is your responsibility to keep this data correct

Support
We provide support via e-mail using a secure ticketing system via the client area at http://my.webkinect.co.uk which is available 24 hours a day, 365 days a year. To provide efficient service and comply with data protection laws, any requests for changes to your account (including billing changes, password changes or any other technical changes) must be requested by opening a support ticket through your client area from your registered email address.

Backups and Data Loss
Your use of our services is at your sole risk. Web Kinect is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.

We provide the ability for you to backup the entire contents of your server package with us through your Control Panel. We have provided a short video tutorials showing you how to manage all aspects of the features within cPanel including how to use the backup feature here.

Overusage
Account usage is checked frequently. All accounts will receive notification when bandwidth usage is nearing the account's limit. Overusage will result in automatic account suspension unless a prior agreement has been reached. Usually the cheapest option is to upgrade to the next package where available, otherwise our standard charges are £2 per 1Gb/1000Mb per month for additional bandwidth usage and £3 per 100Mb disk usage which can be purchased at any time through Product Addons. Upon suspension please contact us to arrange upgrade pricing.

You agree to use our shared hosting services for the purpose of hosting a website. No bulk processing or bulk mailing or other resource-intensive activity is permitted without written consent. We reserve the right to enact defensive movements to maintain the stability of our systems for all clients.

If you believe your website may be susceptible to high or otherwise abnormal usage you must contact us to discuss the suitability of our shared hosting environment.

Sponsored and Discounted Hosting
From time to time we offer Sponsored hosting accounts. We also offer discounted services to registered UK Charities.
These accounts are limited in availability and are provided on a 'first come first serve' basis. In addition to these standard terms, the following also apply:

  • A selection of banners, including the relevant html code have been provided for your usage. One of these banners must be present and in a prominent position on your website. This should be the index page, the page first seen by your visitors. A landing page will not be accepted.
  • Your website must contain legal content as laid out in these terms.
  • Your website must receive traffic from legitimate visitors. Websites setup for advertising revenue will not be accepted.
  • Only one account is available per customer.
  • You must use the account. Persons who sign up for an account and do not use it will have their account terminated after 7 days of no activity.
  • These accounts are subject to review every month.

Free Downloads
Web Kinect provide a number of free downloads for our clients. Any free downloads provided are not supported by Web Kinect and are used at your own risk. Should a support issue arise you should contact the developer of such software/products for support. Web Kinect will not be held responsible for any issues or damage caused relating to such items.

DCMA Act (Digital Millenium Copyright Act)
It is our policy to respond to clear notices of alleged copyright infringement. If it is brought to our attention that content held on our servers are in breach of the DCMA Act the content will be immediately removed and a warning issued to the account holder. If a second breach is given then the account in question will be terminated and you will be given 24 hours to remove all of your data from our servers. Once this time has passed all content will be deleted and will be un retrievable.

Disclaimer and Limitation of Liability
We are unable to assert fitness for any specific purpose and as such Web Kinect cannot be held liable for any form of consequential loss or damage caused directly or indirectly by use of our service, misuse of our service, downtime, service issues, data loss or any other event. In the event of any preventable disruption to service we will credit your account as described in our Service Level Agreement. Our liability will not exceed the total amount paid for the service. If you have sensitive or mission-critical data to host, you must seek your own insurance and independent legal advice.
